California has zero tolerance for under-21 drinking and driving. A BAC as low as 0.01% triggers automatic license suspension — and additional charges if BAC is higher.
The three under-21 DUI thresholds
BAC 0.01–0.04% — Zero Tolerance (VC 23136)
Civil infraction. Automatic 1-year license suspension by DMV. No criminal record. No jail. But the suspension is "hard" — no IID, no work restriction.
BAC 0.05–0.07% — Lower BAC DUI (VC 23140)
Infraction. $100 fine. 1-year license suspension. 3-month DUI school. Misdemeanor record possible if combined with other violations.
BAC 0.08%+ — Standard DUI (VC 23152)
Misdemeanor. Same penalties as adult DUI: fines, jail, probation, DUI school, criminal record. Plus the under-21 license suspension on top.
License consequences
The DMV imposes its own suspension separate from any criminal penalty:
- 1-year suspension for any BAC ≥ 0.01%
- If under 18: license cannot be reinstated until age 18 + 1 year
- "Critical need" hardship license possible after 30 days
The 10-day DMV hearing rule applies
You have 10 days from arrest to request a DMV hearing. The same defenses available to adult DUI also apply: improper stop, faulty test, observation period violations.

- Mouth alcohol: Cold medicine, mouthwash, breath spray
- No probable cause: Random stops without reasonable suspicion
- Faulty PAS device: Roadside breathalyzers are less reliable than evidentiary devices
- Title 17 violations: Improper test administration

Will an under-21 DUI affect college admissions or financial aid?
Possibly. Many universities ask about criminal history on applications. While VC 23136 is a civil infraction (not criminal), companion VC 23140 or 23152 charges create criminal records. Federal student aid is affected by drug convictions (not alcohol), but college disciplinary processes may consider DUI.
Can I get a hardship license under 21 after a DUI suspension?
